Despite the anticipated backlash, the former president proceeded, choosing what Hunter described as family over his own political standing, stating, "That's how much you know my dad loves me. He chose me over his political legacy." The pardon, issued in December 2024, notably reversed earlier promises by Joe Biden to refrain from intervening in his son's federal legal challenges, which included gun and tax-related offenses. This act occurred just prior to sentencing in both cases and weeks before the elder Biden concluded his presidential term.

Hunter Biden clarified that his father's initial reluctance to issue a pardon was genuine. However, he explained that the landscape shifted dramatically following Donald Trump's victory in the 2024 presidential election. The prospect of a second Trump administration and its potential implications for his legal battles heavily influenced his father's eventual decision. Hunter described the situation as akin to having "a gun to my family's head for the next four years," framing the pardon as an "incredibly rational" yet "difficult decision."
